A CHARTER ORDINANCE EXEMPTING THE CITY OF STERLING, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-4112 AND AMENDMENTS THERETO CONCERNING COURT COSTS, AND REPEALING CHARTER ORDINANCE NO. 11 OF THE CITY OF STERLING, KANSAS.

WHEREAS, the City of Sterling, Kansas, previously exempted itself from the provisions of K.S.A. 12-4112 by Charter Ordinance No.8, and

WHEREAS, the City of Sterling, Kansas, previously set court costs at $25.00 by Charter Ordinance No. 11, but that the Governing Body of the City of Sterling, Kansas, deems it advisable to increase such court costs at this time, and to allow for future changes in court costs without necessity of Charter Ordinance,

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF STERLING, KANSAS, AS FOLLOWS:

SECTION 1. The City of Sterling, Kansas, a city of the second class under and by virtue of the power invested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself from the provisions of K.S.A. 12-4112 inasmuch as the statute does not allow municipal court costs to be assessed. All other provisions of such statute are unaffected by the passage of this Charter Ordinance.

SECTION 2. Court costs in the amount of $30.00 shall be assessed to each case filed in the Municipal Court of the City of Sterling, Kansas, payable by the defendant upon conviction or entry of plea of guilty or no contest. Such court costs shall be in addition to any fine, restitution, or other lawful order of the Municipal Court. Hereinafter, by regular ordinance, the Governing Body of the City of Sterling, Kansas, may increase or decrease such court costs as it deems necessary.
