For the purpose of this article circus, means an establishment, whether stationary or mobile, where animals are kept or used wholly or mainly for the purpose of performing tricks or maneuvers. For the purpose of this article carnival means an itinerant enterprise consisting principally of temporary amusement devices or mechanical rides, acrobatic or magic shows, games, stunts or zoo animals operated to provide entertainment or amusement to the public.

It shall be unlawful for any person to engage in the business of operating a circus or a carnival within the city limits of the City of Sterling without first obtaining an operation permit for such from the city clerk, prior to entering the city.

All circuses and carnivals shall pay a permit/license fee of$25.00 per day.

Each permit shall be valid from the date of its issuance until the last date of the circus or carnival, but in no event shall the permit be valid for a period to exceed fourteen (14) days.

There shall be no refund in the event the circus or carnival is canceled, for any reason.

Prior to entering the city, all circuses and carnivals shall provide to the City a certificate of public liability insurance in a minimum amount of $1,000,000, written by an insurance carrier licensed to do business in the state.
